CLIENT AND Designer (Britani Dostal) agree to the following;


DESIGN AGREEMENT

I, (Britani Dostal), agree to create a freelance graphic design concept suitable for your business identity and satisfactory to you. I promise to deliver your finished graphic design digital image files of high enough quality to be printed on business related print goods and for web page display once I have been paid in full.


DETAILS


Logo

Logo Concepts and First Viewing: Within seven business days of receiving your company info, I will create up to three different logo concepts for you. When I have received your feedback on these designs I will make any needed changes to your logo choice.

File Delivery:

After the final logo design is approved I agree to deliver the logo design to you as digital

files (.png, .pdf, .svg, and/or .jpg graphics file formats). Custom logo packages are delivered to you by e-mail or if the files are very large, you will be given a private link to download a zipped folder of all your files.

Website

Website Concept and First Viewing: Within seven business days of receiving your company info, I will start building a website custom to your business. I will keep you in the loop along the designing process to make sure it fits your business message and satisfies your branding needs. Revisions may be made only by the Designer at the Preliminary Design phase. Additional fees will be charged for revisions made after 5 preliminary design revisions, and for additions to project scope. Note: If you're also requesting e-Commernce, e-mail and other website add-ons, please understand this will have an extended completion timeline.


OWNERSHIP

I give you the right to use your new logo and graphic designs in all media useful for your business promotion. I ask that you let me display your new Logo Image and your name/business name and website address, for testimonial and promotional purposes in my printed and online portfolios and in printed ads.


ORIGINALITY

I affirm that my Designs are original and that I own the rights granted under this

agreement, and that the rights granted do not conflict any other agreement.


PAYMENT

Fifty percent (50%) upon project commencement, remaining upon project completion.  A two percent daily service charge will be issued against past-due deadlined payments. Grant of copyright is conditioned upon receipt of final payment, and upon Client's compliance with the terms of this agreement. 


CLIENT

The Client will be notified and must approve any and all materials prior to project finalization and submission. Furthermore, the Client will have permission to accept the work and request revisions if needed. In return for the below-described design, Client agrees to pay a design retainer fee of 50% before any work begins and the remaining payment when design is completed and approved.


OWNERSHIP

I understand that the final Design belongs to Dostal Digital & Design Co. until Client has paid in full. In the event of termination of this Agreement, Dostal Digital & Design Co. owns the Logo and Website and has the right to complete, exhibit, and/or sell the Design if she so chooses. She also owns all the logo design concepts created. In the event of Cancellation, Designer will be compensated for services performed through the date of cancelation in the amount of a prorated portion of the fees due. Upon cancellation all rights to the website revert to the Designer and all original art must be returned, including sketches, comps, or other preliminary materials.


USE OF LOGO

I understand that once I have paid in full that I have the right to use the Logo Design in all

media useful for business promotion and that Dostal Digital & Design co. reserves the right to display the logo in portfolios and promotional displays (example: logo designs on websites or printed on flyers).

It is also up to me to do a Trademark search and federal trademark registration if I want to register my Logo as my company Trademark. (Start here to learn more about Trademarks: http://www.uspto.gov/main/trademarks.htm )


TERMINATION

 Client has the right to terminate this Agreement if, Dostal Digital & Design Co. fails to complete the design within 30 days of the project deadline inputted during signing of this agreement or if, illness or injury, or events beyond our control causes a delay of more than 60 days from the agreed delivery date.

First, Last

This freelance graphic design contract is made on this date between Dostal Digital & Design Co. (Britani Dostal) and the Client listed above.

The Designer agrees to provide graphic design services as listed in the “deliverables” section above. The Designer agrees they will remain the sole provider for the term of this project. All work will remain unique, original, and free of any plagiarism. Check all that apply to your desired design package.

Note: Quotes do not include taxes. If any add-on's are included after this quote, totals are subject to change.

Dostal Digital & design Co. requires a 50% retainer before beginning a project, with final payment due upon project’s completion. If the Scope of work changes during the project’s completion additional costs may occur. Designer will submit any price changes to the Client prior to beginning such tasks.

The Designer hereby acknowledges he/she may be involved in or become aware of information that relates to the client on a personal level including information related to the client’s past, future, present, customer names, marketing plans, project information, and financial documents. The Designer agrees to protect all the above information and keep any information obtained confidential. However, the Designer will be permitted to display final work on their website or in promotional materials.

Either party may terminate this contract at any time for any reason they deem necessary with written notice. Upon cancellation of this freelance graphic design contract, the Client will be responsible for all expenses incurred prior to contract termination. Should the Client choose to cancel this project after the project’s completion, the client will remain responsible for full payment of the complete project total.

BY CHECKING THIS BOX AND SIGNING MY NAME BELOW, I AM ELECTRONICALLY SIGNING THIS CONTRACT AS WRITTEN. I UNDERSTAND THAT AN ELECTRONIC SIGNATURE HAS THE SAME LEGAL EFFECT AND CAN BE ENFORCED IN THE SAME WAY AS A HANDWRITTEN SIGNATURE.
